Service description
DuePact provides delinquency resolution intelligence for residential property management teams. The service includes resolution packet generation, queue management, compliance flagging against rules you configure, payment-plan drafting, resident promise tracking, and portfolio reporting.
Not legal advice
DuePact is not a law firm and does not provide legal advice. Compliance flags reflect the rules you configure in the policy engine; they do not constitute a legal opinion. Consult qualified legal counsel for jurisdiction-specific questions about notices, fees, fair housing, eviction, or collections practice.
Not a payment processor
DuePact does not process, collect, hold, or transfer resident payments. Payment plans drafted in DuePact are recommendations for your team to act on inside your own systems.
Not a communication tool
DuePact does not contact residents on your behalf. Notices, calls, emails, and any other resident-facing communication are sent by your team through your own channels.
Human approval required
All recommendations produced by DuePact — notices, payment plans, fees, escalations, and legal handoffs — require your explicit approval before execution. You are responsible for every action your team takes, whether or not DuePact recommended it.
Your data
You retain ownership of all data uploaded to DuePact, including resident data. You grant DuePact a limited license to process that data solely to provide the service to you, as described in the Privacy Policy.
Accuracy
DuePact's outputs depend on the data you provide. If your ledger data is incomplete, stale, or incorrect, the resulting resolution packets will reflect those errors. Review every packet before acting on it.
Acceptable use
Use of DuePact is governed by the Acceptable Use Policy. You may not use DuePact to discriminate against protected classes, circumvent fair housing requirements, automate adverse actions without human review, or harass residents.
Billing
DuePact is billed per managed unit per month at the rates published on the Pricing page. Subscriptions may be cancelled at any time and remain active through the end of the billing period. No refunds are issued for partial months.
Liability
To the maximum extent permitted by law, DuePact is not liable for: actions your team takes based on recommendations; compliance, regulatory, or legal outcomes; resident outcomes or disputes; or financial losses arising from use of the service. Recommendations are tools to support your team's professional judgment, not a substitute for it.
Termination
Either party may terminate the agreement with 30 days' written notice. On termination, account data — including resident ledger data — is available for export for 90 days, after which it is deleted from production systems. See Privacy Policy for full retention terms.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
